Welcome to Zap-Kapow Comics Club ("Service"), operated by ZAP-KAPOW COMICS LLC ("Company," "we," "us," or "our"). By accessing or using the Zap-Kapow Comics Club website at club.zapkapowcomics.com, our mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Description of Service

Zap-Kapow Comics Club is a comic book price guide and collection management platform. The Service allows users to browse a catalog of over 450,000 comic book issues, view market valuations based on completed eBay sold listings, manage personal comic book collections, maintain want lists, receive price alerts, and access historical pricing data. The Service is available via web browser and mobile applications.

2. Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must be at least 13 years of age to create an account. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.

3. Subscription Plans and Pricing

Zap-Kapow Comics Club offers the following auto-renewable subscription plans:

Monthly Plan: $4.95 per month
Annual Plan: $49.95 per year

Both plans include a 7-day free trial for new subscribers. Subscription features include full collection management, want list tracking, price alerts, complete price history charts, and data export capabilities. Free users may browse the comic book catalog and view current market valuations without a subscription.

4. Free Trial

New subscribers are eligible for a one-time 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription at the applicable rate. Free trial eligibility is limited to one trial per user across all platforms (web, iOS, Android).

5. Billing and Auto-Renewal

Web Subscriptions

Web subscriptions are billed through Stripe. Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.

Apple App Store Subscriptions (iOS)

If you subscribe through the Apple App Store, payment will be charged to your Apple ID account upon confirmation of purchase. Your subscription will automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the applicable subscription rate. You may manage your subscription and turn off auto-renewal in your Apple ID Account Settings after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Google Play Subscriptions (Android)

If you subscribe through Google Play, payment will be charged to your Google account upon confirmation of purchase. Your subscription will automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period. You may manage your subscription and turn off auto-renewal in your Google Play Account Settings after purchase.

6. Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. No partial refunds are provided for unused portions of a billing period.

For subscriptions purchased through the Apple App Store, refund requests must be submitted to Apple in accordance with Apple's refund policy. For subscriptions purchased through Google Play, refund requests must be submitted to Google in accordance with Google Play's refund policy. ZAP-KAPOW COMICS LLC does not process refunds for purchases made through the Apple App Store or Google Play.

For web subscriptions purchased through Stripe, please contact [email protected] to request a refund. Refund requests are evaluated on a case-by-case basis.

7. Pricing Data Disclaimer

All comic book pricing and valuation data provided through the Service is based on publicly available completed eBay sold listing data and is intended for informational and reference purposes only. Pricing data represents recent market transactions and does not constitute an appraisal, guarantee of value, or offer to buy or sell. Actual market values may vary based on condition, grading, buyer demand, and other factors. ZAP-KAPOW COMICS LLC makes no warranty or representation regarding the accuracy, completeness, or reliability of pricing data. You should not rely solely on the Service's pricing data when making purchasing, selling, or insurance decisions.

8. Intellectual Property

All cover images, title names, character names, and other bibliographic data displayed in the Service are the copyright and trademark of their respective owners and are used under Fair Use for identification purposes only. ZAP-KAPOW COMICS LLC makes no claims of ownership over such materials.

The Zap-Kapow Comics Club name, logo, website design, and original content are the property of ZAP-KAPOW COMICS LLC and are protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from our original content without prior written consent.

9. User Conduct

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service or its systems
Scrape, crawl, or use automated means to extract data from the Service without written permission
Interfere with or disrupt the Service or its infrastructure
Impersonate any person or entity
Share your account credentials with third parties
Resell or redistribute data obtained from the Service

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we deem harmful to the Service or its users. Upon termination, your right to use the Service will immediately cease. If your account is terminated for cause, you will not be entitled to a refund of any subscription fees.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ZAP-KAPOW COMICS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service, regardless of the cause of action or the theory of liability. Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you have paid to us in subscription fees during the twelve (12) months preceding the claim.

13. eBay Partner Network Disclosure

Clicking on eBay links within the Service and making a purchase may result in ZAP-KAPOW COMICS LLC earning a commission from the eBay Partner Network. This does not affect the pricing data or valuations displayed within the Service.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last Updated" date above. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Tulsa County, Oklahoma.
